Customers provide express written consent to receive automated marketing text messages through consent mechanisms presented at checkout or through other opt-in forms on our Site. Consent to receive SMS messages is not required to make a purchase.
4.2 Message Frequency and Rates
Message frequency varies based on your interaction with our Site and promotional calendar. Standard message and data rates charged by your wireless carrier may apply. BEL USA is not responsible for carrier surcharges.
4.3 Opt-Out Instructions
You may opt out of receiving SMS messages at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message. You will receive a final confirmation message upon successful opt-out. 4.4 Do Not Call Compliance
BEL USA conducts outbound telephone calls to existing customers using cloud-based telephony systems that may include automated dialing functionality, with a live representative always present on the call. We do not use pre-recorded messages for outbound sales calls. We maintain an internal Do Not Call list and honor all opt-out requests in compliance with the Telephone Consumer Protection Act (TCPA), 47 U.S.C. § 227, and applicable state telemarketing laws. BEL USA does not use commercial facsimile transmissions for marketing purposes.
5. Email Marketing and CAN-SPAM Compliance
BEL USA sends promotional and transactional email communications to customers who have provided their email address in connection with a purchase or who have opted in to our email marketing program. Our email marketing practices are designed to comply with the Controlling the Assault of Non-Solicited Pornography And Marketing Act of 2003 (CAN-SPAM Act), 15 U.S.C. § 7701 et seq., and, where applicable, the California Consumer Privacy Act (CCPA).
Our CAN-SPAM compliance measures include:
- Identification: all commercial email messages clearly identify DiscountMugs as the sender.
- Subject Line Accuracy: promotional email subject lines accurately reflect the content of the message and are not deceptive.
- Physical Address: all commercial emails include our valid physical mailing address.
- Opt-Out Mechanism: every commercial email includes a clear and conspicuous unsubscribe link. Opt-out requests are processed within ten (10) business days, as required by law.
- Opt-Out Honoring: once a recipient opts out, we do not send additional commercial emails to that address, and we do not sell or transfer the opted-out address to any third party for emailing purposes.
- Monitoring: our email marketing program is managed through Klaviyo, which provides built-in compliance features including suppression list management, bounce handling, and consent tracking. Our marketing team conducts periodic reviews of list health, unsubscribe rates, and complaint rates to ensure ongoing compliance.
6. Data Retention and Security
6.1 Retention
We retain personal information for as long as necessary to fulfill the purposes described in this Policy, to comply with our legal and contractual obligations, to resolve disputes, and to enforce our agreements. Customer order data is generally retained for seven (7) years to support tax, accounting, and warranty obligations. Employee records are retained in accordance with applicable employment law.
